The 2024 season witnessed the teams and the NASCAR going head-to-head over the new charter agreement for 2025-2031. At the end other than two teams, 23XI Racing and Frint Row Motorsports, signed the new deal. The two teams that refused sign escalated things to the court, filing an anti-trust lawsuit against NASCAR alleging monopoly.
Recently NASCAR filed a motion asking the judge to dismiss the case all together, alleging falsification of truth and more. The FRM-23XI lawyers have now legally responded with the claims with another filing. They have doubled down on the claims of monopoly, highlighting some of the evidence they have already presented.
The motion filed by NASCSAR is really important, as if the judge decides to throw it away, then the discovery process into the finance of the sport will start. This has the potential to open a whole new can of warms if things aren’t as good as they seem. The documents collected from the legal process can help 23XI-FR, lawyers a lot in the fight.
23XI/FRM briefs today reiterate previous arguments. For the judge to dismiss case, he must consider facts the teams present as true & determine there is simply no violation of law. If judge doesn't dismiss case, then discovery (depositions, access to documents/financials) begins. https://t.co/lci6DjnWSp

What is the main argument from 23XI-FRM?
As of now the primary argument regarding the monopoly from the teams is the fact that NASCAR prohibits them from venturing into other stock car racing events. The sole control NASCAR has on Cup tracks and the cars also is an argument.
Some of the arguments from the coalition seems bit farfetched, but in eyes of the law might hold weight. So, it’s important for NASCAR to either win the case or settles the issue outside of the court as soon as possible, for the better future of the sport.
