23XI Racing & Front Raw Motorsports coalition shocked the racing community in 2024, when they filed an anti-trust lawsuit against NASCAR, alleging monopoly. The case has evolved into a huge drama, that has now resulted in 23XI Racing finding themselves in a situation where they will be forced to race as open teams. Hall of Famer Dale Earnhardt Jr. has recently addressed the situation.

The latest court drama is over the injunction lawsuit that the team won ahead of the season that allowed them to race as charter teams, but NASCAR appealed and has won the case, allowing them to remove the charter own by the alliance. The teams have appealed the decision and is the court arguing again.

In the lates episode of his Podcast, JR Motorsports co-owner Dale Earnhardt Jr. shared his thoughts on the big win NASCAR had in the court. But at the same time, he isn’t too concerned about the teams losing the battle, as the real lawsuit is about the charter system. 23XI Racing co-owner Denny Hamlin has the exact same feeling.

That’s fascinating as hell. I did not, in my opinion, it’s a big win for NASCAR… Denny takes the approach that it’s just a small part of the bigger picture in terms of the lawsuit. Which he’s, he’s correct. The lawsuit is about the charter system.

The two opposing parties have widely different ideas about how charters should be handled and these ideas are going to clash if the trial starts in 2025 December as scheduled. He believes at the moment 23XI and FRM sees racing as chartered teams at the moment as a luxury. Hence they are not worried about the loss.

They want a lot of things different than NASCAR does at how the charters are handled. I would be guessing what those things were, but that’s really what this is all about. It’s not so much trying to race as a chartered team this year, they would love that luxury, but it’s still up in the air whether they’ll get it or not. But NASCAR seemed to win a small battle right there.

23XI Racing is open to settlements over the Charter lawsuit

The lawyer for the teams, Jeffrey Kessler shared his thoughts the lawsuit on his latest appearance in the court. He pointed out that they are willing to settle the issue, if there is a fair offer from stock car racing’s sanctioning body.

We’ve always indicated that if there could be a fair settlement breach, that we could come to something that’s good for everybody, I’m a lawyer, I am always open to settlement. I think my clients are always open to settlement.

Jeffrey Kessler said.

They are ready for the trail, if they fail to settle things outside of the court, but the growing sentiment in the community as well as the legal teams is settling things fast to shift all the focus to racing. Everyone is looking for a system that favors everyone.

(If) they’re not going to agree to anything, we’ll see them at trial. We are very much open to what all the judges are saying … this is a case that should be settled and worked out so that everyone could go forward racing. The fans don’t have to read and hear about all of this, and could have a better system for everyone.

Jeffrey Kessler added.

The comments from the lawyers and the NASCAR experts shows the situation is pretty tense at the moment. For everyone involved the best-case scenario is an off-court settlement as if one of the two parties won the trial, there will only be more appeals and more uncertainty for a long-time.
