Video games are becoming more and more popular nowadays. In addition, new games that rule the market come out essentially every year. The increasing number of video game companies, franchises, and platforms, such as the PlayStation and Xbox, has contributed to the growth of the gaming notion. Furthermore, Epic Games has seen a lot of success over the past few years. However, the time isn’t in favor of the Fortnite creators as Apple, the Tech giant, has demanded Epic Games pay an outrageous amount of $73,000,000 in Legal costs!

Legal battles are raging everywhere nowadays. Moreover, with gaming becoming a widespread culture, creators and platforms have created a monopoly for respective devices. The recent war between Sony & Microsoft regarding Microsoft’s acquisition of Activision Blizzard King. Sony’s claim was that Microsoft would create a monopoly of COD games and would hamper fair market competition. However, after months of court trials, Microsoft succeeded with its acquisition.

Furthermore, another court case in 2021 kept gamers all around engaged throughout. It was the Epic Games vs Apple, the Tech giant & iPhone makers court trial. Epic Games has made many claims regarding Apple’s App Store creating a monopoly over mobile games. However, the Fortnite creators suffered a huge loss against Apple, and now Epic Games has to pay huge amounts of fees in legal costs.

In 2021, Epic Games filed a court case against Apple over Tech giant’s alleged unfair monopoly over the App Store. Furthermore, Epic Games made ten different claims to support their case; however, they lost 9 of them against Apple. This led to Apple winning against Epic Games with a landslide. Furthermore, the court ruled that Epic Games needs to pay the damages to Apple in legal fees, lawyers hired, and damages caused to the company due to fluctuating market image. And Apple has finally handed the slip to the Fortnite creators and the sheer amount of money has titled the fan base.

Epic Games has to pay Apple a sum of $73,404,326 to cover the legal costs & damages. This staggering amount of money has shocked fans and the company itself. However, Apple has said that the amount they have proposed is already a generous one. The sum of $73,404,326 is after Apple granted a “very generous” 10% reduction on its $81,560,362 total legal expense. Companies have to pay these out-of-pocket costs as a result of contract or tort disputes.

The reason behind this 10% discount, as put forward by Apple, is that Epic Games at least won one out of their ten claims. And thus, winning that one claim, Apple granted Epic Games a so-called discount of 10%. Apple also said,

“Although it would be reasonable for Apple to seek the total amount of its Losses in this matter, it has provided a 10% discount in recognition of Epic’s win on one out of ten of its claims. This 10% overall reduction is extremely generous, given the undisputed fact that the UCL claim did not constitute nearly 10% of the litigation, as this Court recognized.”

Apple has also said that Epic Games can’t contest its claim for damages under any circumstances. This is also because Epic Games breached their contract against Apple, thus leading to such a drawn-out and financially demanding court case. This is a huge amount for Epic Games, and the game company would definitely find some way or loophole to contest this demand from Apple.
