FIA to double down on Red Bull and other teams for taking advantage of budget cap loop holes with new directive
The regulatory body had introduced the budget cap from the 2021 season onwards.

FIA is the regulatory body of F1 and provides the rules and regulations for the sport to function properly. From the 2021 season onwards, a cost cap was placed on teams to reduce the difference between the top and bottom halves. However, teams had found a clever loophole to spend more than their allotted budget, and FIA wants to remove it.
The first victim of the cost cap was Red Bull, which had spent more than the allotted budget of $145 million(it is currently $135 million) in the 2021 season. Moreover, the team was penalised and people thought that the cost cup was functioning properly. However, a clever evasion technique was also used by Ferrari, Red Bull and other teams. The teams had employed expert engineers for its other ventures and written off their salaries on other projects.
Now, the French body has decided to take action. FIA has decided to include a clause that whether any personnel has worked for the team at any time throughout the year, then its salary would be documented in the team’s expenses. This change can unsettle the team’s budget and can incentivize lay-offs by the team. However, it will be implemented in 2026 not with the TD45, as not many teams voted in favour of it. On the other hand, it is anticipated that the teams will find a way around this clause after its implementation.
Zak Brown’s verdict on the state of loopholes in the cost cap?
Zak Brown is McLaren’s CEO and is fully aware of the current state of the cost cap and how it is being operated. The team had been provided a green chit for the 2021-22 seasons, and spent under the cost cap.

[With] TD45, there was a reason why that was put in place. And so hopefully that will close any additional loopholes. TD45 is something that will close any loopholes that may have still been existing.Zak Brown said as reported by autosport.com
The American claimed that there are no loopholes left in the regulation. The teams now have a level playing field and will be in a tough battle to stay under the limit.
The English team has been quite proactive about the correct implementation of the rules and is happy with the action taken by the FIA. On the other hand, the team is preparing themselves for the season opener in Bahrain and would be looking to secure the top positions after their incredible latter half of 2023.
