The entire NASCAR community is one it toes as the infamous anti—trust lawsuit filed by 23XI Racing and Front Row Motorsports is going to trial on Monday. They accused the stock car racing leadership, as well as the owners, the France family, of monopoly, which if proven will change the structure of sports as a whole once and forever.
There is no clear favorite to come out victorious after the lawsuit as both Jim France and Michael Jordan’s legal teams have their own challenges ahead. The common belief among the community is that unless the federal lawsuit isn’t settled outside of the court, both sides are going to experience significant loss, even the victor.
Ahead of the trial, that will start with weeks of jury selection and deliberation, senior NASCAR journalist Bob Pockrass of Fox Sports details what happened if Michael Jordan and Denny Hamlin’s team come out victorious. In a post on X, he pointed out that the teams will earn significant compensation if they win as well as big change to the NASCAR system.

23XI and FRM experienced massive drop in revenue in 2025 season, after they were stripped of their charter status for not signing the new deal, which started the whole legal drama. The team filed multiple injunctions in the court to not race as open teams and initially experienced success, before ultimately the court ruled against them.
There are some major challenges ahead of Michael Jordan to win the case
It won’t be easy for 23XI Racing and FRM to win the lawsuit as there are some significant challenges ahead of him. Bob Pockrass reported seven points that he sees as significant and can influence the final outcomes.

The first two points the fact that 23XI Racing brought into the same NASCAR system they are now opposing back in 2021, by purchasing charters and knew the risks. Unlike many of their counterparts including FRM, 2XI is operating profitably, showing the positive side of the system.
The next points are the new revenue sharing deal and charter price. The price the charter are not at all time high, giving teams to cash in on the opportunity and the payout for the teams at the end of the season has also significant increased.
The next points are the need of NASCAR to bee exclusive and how some of the deals they have made might seem monopolistic but are required. Th sport, like Formula One needs to remain exclusive to earn more revenue from their TV deals.
Another important point is how the new teams joined the sport, with the Next-Gen are more competitive, showing a fair environment in the sport, with 223XI and Trackhouse being the perfect example. The last point is the fact no new series like NASCAR has started and failed due to monopoly. SRX is a distant example to it, but the series failed due to many other reasons.

The points and arguments made by Bob Pockrass seems rational challenges that are ahead of the team alliance going into the trial. It would be interesting to see who would come out victorious once the legal battle is over.
