The 2024 Cup season was marked with the intense charter negotiations between NASCAR and the 15 teams. Things went from bad to worse after, 23XI Racing and FRM filed a federal anti-trust lawsuit against the owner’s series after refusing to sign the 2025-2031 charter deal. This lawsuit has also caused some serious uncertainty over charter sales happened in 2024.
With Stewart Haas Racing ceasing their operations at the end of this season, three Cup charters are in the market, with three teams already having agreement to buy them. Ironically two sides buying these charters are 23XI and Front Row Motorsports, and with NASCAR not yet validating the sale. Now 23XI co-owner Denny Hamlin has given a latest update on the sale.
As reported by Fox Sports’ Bob Pockrass, 23XI hasn’t had any discussing with NASCAR about the charter which is currently part of the agreement for latest season. He admitted that there is no deadline, or decision has been made about the sale, as purchase of the charter might become a backup plan for the team for 2025.
Denny Hamlin said he has not had discussions with NASCAR about the approval of an SHR charter transfer to 23XI (23XI has an agreement to buy one) after this season and doesn't know of any deadline for a decision on it. https://t.co/vAiq64RHfD

SHR’s Joe Custer also gave an update charter sale
Ahead of the Xfinity race, SHR’s Joe Custer has confirmed that the sale of the charters is still on and the team has no plans to back down from it. They are not willing to have more than one charter for the 2025 season.
Checked in with SHR's Joe Custer on pit road prior to Xfinity race. He told me their understanding as far as their charter sales is no change to the process or the expectation. He isn't planning on having more than 1 charter nor having to sell the charters to someone else.

The comments from the two teams suggest that the sale is on, and both have no plans to backtrack. Now the ball is in NASCAR’s court, they can either approve or deny the charter take overs. Their decision will have a major influence on lawsuit saga.
