NASCAR has made some radical changes to the penalty appeal process amidst the drama surrounding the recent penalty adjustment following the HMS apparel. NASCAR has essentially reduced the power the three-membered independent committee has over changing the severity of the penalty. So the committee can’t reduce the point penalty imposed on teams if the infraction is proven.
All four cars of Hendrick Motorsport were penalized for unsanctioned modification of hood lovers and were given severe championship and point penalties alongside suspension and fine. The team appealed the decision, and though they were found guilty, their points were reinstated. At the same time, Kaulig Racing was sanctioned on the same count, their appeal was rejected, and the penalty was upheld.
23XI Racing driver Bubba Wallace’s spotter Freddie Kraft, the Co-host of the famous NASCAR podcast Door Bumper Clear has been a vocal critic of the decision. Kraft was pleased with the rule tweak and, when asked by his podcast host Brett Griffin about the involvement of NASCAR in the appeals hearings, pointed out that the appeals committee acted like idiots with the HMS case and said the update was necessary.
“Okay, I read this. Freddie Kraft still got the stance they aren’t involved in the appeals process? Cause they are now if they weren’t before,” Griffin asked while sharing a tweet by Bob Pockras about the rule change.
“Yep, same stance…The appeals committee looked like idiots last week when they admitted Hendrick broke the rules, but gave them their points back. Now NASCAR is stepping in to say it’s a penalty or it isn’t, the appeals committee doesn’t get to adjust the penalty as severely,” Kraft replied.

Bubba Wallace and Freddie Kraft saw their boss’s penalty being upheld as well
The duo’s Boss and Joe Gibbs Racing, Denny Hamlin, has had a rough week. He was hit with a $50K fine and 25 points deduction that changed the team’s position in the championship standing. Hamlin was fined for deliberately trying to wreck Ross Chastain.
The outcome of the HMS panel, though, was for a different infraction, I was confident that even if he got fined, it would be overturned. But the three different members who presided over his case weren’t convinced about the legality of his move and refused to change their actions.
