The NASCAR nation is divided and disturbed over the latest ruling from the NASCAR appeal body over the L2 level penalty imposed on Kaulig Racing. They were heavily penalized for an unsanctioned update of single vendor-supplied parts, the hood louvers. The same penalty was given to all 4 cars of Hendrick Motorsports for the infractions.

Last Wednesday, a three-membered independent body heard the HMS plea and passed a verdict in their favor. The penalized points were re-instated, and only the fine combined $400K fine was upheld. Kaulig was hoping for a similar outcome, but the appeal committee, with three different members from last time, had a different verdict.

“I respect everybody, but it’s disheartening. Everyone knows what goes on in the garage area with single-source parts. I stand by my guys, and I say that we upheld the rules,” Kaulig president Chris Rice said after the penalty review verdict that the team still feels they haven’t committed any infractions.

The only thing that happened to the team from the appeal was that their championship and owners’ points penalties were reduced to 75 from 100. Their 10 playoff points deduction is also upheld. The lack of transparency in the process limits the parties not involved in the appeal from accessing statements or data from the hearing. The Panel members for this hearing were Hunter Nickell, Shawna Robinson, and Steve York.

Fans on social media were furious at the appellate body’s decision and were quick to express their concerns over the lack of transparency and consistency in decision-making. Some fans even made corruption accusations and Hendrick Motorsports bias accusations against the process and called for more transparency.
