NASCAR’s legal battle with 23XI Racing and Front Row Motorsports has been heating up. In the past few weeks, the two Cup Series teams have been on the backfoot with courts making them lose their charter rights. Now, NASCAR has claimed that it wants to sell the charters previously owned by the teams as early as possible.

23XI Racing is co-owned by NBA legend Michael Jordan and NASCAR’s Denny Hamlin. It is one of the newer teams in the field and has a strong technical alliance with Joe Gibbs Racing. According to NASCAR reporter Bob Pockrass, in the latest filing, NASCAR has claimed that it has received interest from multiple parties to buy the charters of 23XI and FRM.

This not only includes current Cup teams but even names outside of NASCAR. Though, details have not been released. Moreover, the filing insisted that the sale of charters takes place via a 30-day bidding process. However, to complete this process, NASCAR needs to begin it instantly so that new teams can start their preparations by October 1.

Bob Pockrass wrote on X,

This filing was done in response to 23XI and FRM’s request to continue racing under charter status till the end of the season. Front Row Motorsports as well as Michael Jordan’s team could have severe consequences as a free entry, potentially even leading to drivers becoming free agents.

NASCAR cites F1 in latest Court filing

NASCAR has pulled all its strings in the battle over charter rights with the two teams, and it is not holding back. The sport has also made major claims over revenue sharing with Cup teams, demanding compensation from 23XI Racing and Front Row Motorsports.

In a separate post, Bob Pockrass wrote that NASCAR claims to be sharing a higher percentage of revenue with Cup teams than even Formula 1, the pinnacle of motorsport. The series also pointed out that the two teams remain in the field courtesy of a rule change made in July.

Now, NASCAR wants 23XI and FRM to pay back the revenue they received through their charters from NASCAR earlier this year. Instead, the sport will use that money to distribute it amongst the current chartered teams.

Some nuggets: -NASCAR pays team higher % of revenue than F1 -Teams have starting spots for 2025 b/c July rule change -NASCAR wants 23XI/FRM to pay back charter $ from earlier injunction. the plan for the $ that NASCAR wants back from what they paid 23XI/FRM as chartered teams earlier in the year would be for the current chartered teams to get that $.

Certainly, 23XI Racing and Front Row Motorsports are getting cornered by NASCAR. The Michael Jordan-owned team as well as FRM must make a strong case in the coming weeks to be able to sustain commercial operations. The trial will commence in December, giving NASCAR plenty of time to pull up more such aggressive moves.
