The former Green Bay Packers quarterback Brett Favre has been accused of misusing the Mississippi welfare funds. Favre is not facing any criminal charges over the incident but the 11-time Pro Bowl signal-caller is facing a civil lawsuit. Favre has repeatedly claimed that he has done nothing wrong in the scandal and is seemingly very confident about winning the civil case.

And now, a new report by Front Office Sports suggests that Brett Favre, “does not intend to invoke the Fifth Amendment right against self-incrimination” in the Mississippi case. Favre’s legal team has filed a motion to prevent a stay in the case as the Mississippi state looks to get back the funds allegedly misused by Favre that originated from the Temporary Assistance for Needy Families (TANF) federal program.

“Favre would be severely prejudiced by a stay,” wrote Eric D. Herschmann, Favre’s lead attorney, wrote in the motion. “A stay under these circumstances would unduly delay Favre’s opportunity to have his day in court and clear his name.”

The problem for the former Packers QB is that he would almost certainly lose the civil case if he invoked the Fifth Amendment since he would not be refuting the evidence against him.

But if he says anything to clear his name in the civil suit, that could be used against him in a possible criminal case as new evidence or it could end up sparking a totally new investigation for the chances of the Packers icon potentially lying under the oath to save his face. It’s a lose-lose situation for the Pro Football Hall of Famer.

The Super Bowl-winning QB Brett Favre is among more than 40 people currently facing a civil lawsuit over the alleged misused funds of the Mississippi welfare scandal. What did the Packers icon Favre do?

The legendary NFL quarterback allegedly used $1.1 million from the welfare funds to build a volleyball facility in his alma mater, the University of Southern Mississippi. Favre’s daughter also played volleyball at the same school.

Favre later claimed that he didn’t know where the money came from. However, some text messages from August 3, 2017 show Favre asking MCEC (Mississippi Community Education Center) founder Nancy New about privacy regarding the money.

“If you were to pay me, is there any way the media can find out where it came from and how much?,” Favre asked in a text message according to CBS Sports.

Nonetheless, Favre has returned the $1.1 million to the state of Mississippi and is not facing any criminal charges for now. But if he were to spill any new evidence during the civil lawsuit case, he might end up facing a criminal charge in the future.
