In the latest court findings, Johnny Gaudreau and his brother Matthew Gaudreau’s assailant, Sean Higgins, pleaded to have his indictment lessened. Higgins can find himself behind bars for 60 years if convicted.

The driver claimed that he was being unfairly prosecuted when the NHL brother’s blood-alcohol levels were far higher than his. According to reports, Sean Higgins had a BAC of .087 while Johnny Gaudreau had a BAC of .129 and Matthew had a BAC of .134.

Lawyers of Higgins made the claim to request information about details on how the court measures the blood-alcohol concentrations of the driver and the victims. In another filing, the defense also claimed that Higgins was being unfairly overcharged with vehicular homicide and aggravated manslaughter.

However, the court papers don’t allege Johnny Gaudreau and his brother of breaking the law of drunk driving as the Garden State does not consider bicycles as motor vehicles under State Law. although, riding a bike while being drunk can result in disorderly behavior as per Kugel Law Firm in NY and NJ.

The NHL brothers Johhny and Matthew Gaudreau lost their lives a night before their sister’s wedding last August. They were riding bicycles in Oldsman Township, New Jersey, when the drunk driver Sean Higgins fatally slammed into them.

The fans were enraged to hear the news as it was a deadly hit-and-run case. The sad news doubled down when people found out that Matthew’s wife Madeline was pregnant with their first child during his time of death. 

The tragedy took the lives of two NHL stars, and now the convicted killer, Sean Higgins, is on the verge of receiving a hefty punishment of about 35 to 60 years in prison. While the case is still going on, Higgins pleaded to the court for a lighter sentence.
