Australian judge explains the reason for Novak Djokovic’s ban not being uplifted while Renata Voracova’s ban was reversed easily despite her unvaccinated status

Novak Djokovic, the 21-time Grand Slam champion could not defend his title at the Australian Open since he was deported from the country prior to the start of the tournament over his unvaccinated status which was followed by a three-year visa ban due to his deportation as per the rules of the government of Australia.

There is still no clarity on the upliftment of his ban with judge Jan Redfern clearly stating the reason why the Serb’s ban has not been canceled as well as the chances of being uplifted seem less. He even stated Renata Voracova‘s ban has been revoked after evidence was produced by the Czech to support her stance despite being unvaccinated.

Redfern said that “I also note, for completeness, that Ms. Voracova’s case can be distinguished from the Djokovic case because her visa was not canceled on the grounds of ‘good order,’ nor do the circumstances of her case lend themselves to such a conclusion

Jan Redfern further added that Voracova has produced enough evidence to support her decision for a delayed vaccination due to which her ban has been revoked as a result whereas the case with Djokovic is completely different and will have a tough time ahead especially in convincing the authorities for a possible early comeback.

As already noted, Ms. Voracova is not opposed to vaccination and, unlike the Djokovic case where the minister apparently found there was evidence Mr. Djokovic had shown a disregard for the self-isolation protocols, there is no such evidence before me to this effect in this case,” said Redfern.

She truthfully answered the travel declaration and she had cogent medical evidence to support her exemption, being the evidence provided by her general practitioner about her vulnerability to thrombosis. Notably, Ms. Voracova did not need to rely on the fact that she had previously contracted COVID-19 as a medical contraindication to vaccination because she had a medical basis to delay vaccination.

Djokovic’s long battle still continues with his chances of participation at the Australian Open where he is a record time nine champion is uncertain. He hasn’t dropped a single set since his triumph at Wimbledon followed by the ATP titles wins at Tel Aviv Open and Astana Open with a 9-match winning streak.
