Dani Alves denied bail in s***al assault case, to remain in prison after Spanish Court verdict
The Brazilian international may go for an appeal against the order passed by the Spanish Court to a higher forum to reconsider the options of bail.

Former Barcelona star Dani Alves will probably not get the chance to come out of prison. The Brazilian fullback is denied jail by the Court. The alleged player is facing a trial due to the rape charges that are pressed against him.
Dani Alves has allegedly committed rape of a woman. The incident allegedly took place last December 2022. The Brazilian allegedly had sexual intercourse with a woman in a nightclub without her consent for the same.
The player denied all the allegations of forced sex. The Brazilian International said that the sexual activity that happened between the parties was with consent. The incident took place on 30 December 2022, right after the FIFA World World Cup in Qatar.
The Court of Spain denied bail for the accused Brazilian International. The court gave the grounds for denial as fleeing and tampering with the evidence. The decision was taken after the testimony of the accused, witness and the prosecutrix were taken on record.
What could be the possible punishment for Dani Alves?
The Spanish Penal Laws from Article 178 to 179 speaks about the punishment for rape. If the Prosecutrix proves the charge of rape, the same may not be pleasant for Brazilian International.
The Former Barcelona fullback may be sentenced to a minimum of six years. Given the maximum sentencing scenario, it may be extended up to twelve years. Although in rare cases the maximum sentence is fifteen years, chances of the same look dim. As per Article 179 of the Penal Code rape would consist of “penetration, inserting body parts or objects into either of the former two orifices”.
The former São Paulo defender has only been charged with the accusations of rape. The case is now in the nascent stage and charges are yet to be proved. The Brazilian can only be proved when the allegations are proven by the Prosecutrix beyond an iota of doubt.
The 42-year-old recently underwent divorce from her wife. The Court of Spain has not set any date for trial as of yet. Brazilian International may file an appeal to the higher court to reconsider his petition for bail.
