Daniel Alves could finally know his fate as he remains imprisoned over a sexual assault case in late 2022. The Brazilian footballer is in the Brians II prison awaiting trial. He was accused of sexually assaulting a 23-year-old woman on December 30 at the Sutton nightclub in Barcelona.
Alves had his plea for temporary release dismissed by the Barcelona court, which left him in prison until his trial date. However, the Barcelona court pointed out that “even the DNA analysis that normally delays the procedures for crimes of sexual violence have been practiced”, and it has been confirmed that there were traces of relevant fluids found on the victim’s body, her dress as well as the sink in the private bathroom. All of them matched Alves’ DNA.
“Therefore, it is foreseeable – and desirable – that in a short period of time, the investigation is completed, and the summary concluded, so that the provisional detention can be maintained for a reasonable period of time, without reaching the legally foreseen maximums,” the report added. Regarding the potential prison sentence for Alves, the Prosecutor’s Office said that he faces “a crime of sexual assault with penetration of article 179 of the Criminal Code that provides for a penalty between four and 12 years in prison”.
Judicial sources claim Alves’ alleged abuse of authority will also be considered. If that happens, the former Barcelona defender could face a sentence of between 8 and 10 years in prison.

Security cameras captured Alves walking past the sobbing victim post the incident. The victim immediately contacted security, who informed the Barcelona police. However, by the time the cops arrived, Dani had left the club.
The former Pumas player changed his story several times. Initially, he claimed that he did not know the victim. He then said that all acts between the two were consensual.
