Supreme Court to hear Sourav Ganguly and Jay Shah’s plea for constitutional changes in BCCI tomorrow

A Supreme Court bench under Justice Nageshwar Rao will sit tomorrow and hear the Board of Control for Cricket in India’s (BCCI) plea for changes in the BCCI constitution. The hearing and the judgment are speculated to have a major impact on the future of the BCCI and cricket administration in India.

The hearing is also of huge importance to two of the most important office-bearers in the BCCI, President Sourav Ganguly and Secretary Jay Shah. The future of the duo as office-bearers at the body now lies in doubt and rests largely on the judgment of the Supreme Court. The aforesaid office-bearers became a part of the administration after the enactment of the BCCI’s new constitution based on reforms suggested by the Lodha Committee.

What are the BCCI’s claims?

Now, the hearing is crucial for Ganguly and Shah because as per the BCCI constitution, an office-bearer who has held any post for two consecutive terms in a state association or BCCI can not stay office without a cool-off period of three years. The duo held a post in state associations and hence the concerned clause applies to them.

The BCCI in its plea has claimed that the clause on the cool-off period restrictions worthy and experienced administrators from holding offices. The body ideally wants Ganguly and Shah to complete two terms and stay in their respective posts till 2025.

The BCCI also asks for change in the criteria for disqualifying an office-bearer. Currently the grounds include crossing 70 years of age, insolvency, unsoundness of mind and a lot more. The body now has argued that this scope for disqualification is too wide and must be narrowed down.

It remains to be seen what the Supreme Court bench will decide on following the all-important hearing.
