Brazilian government’s tax department to refund €12 million to Neymar after reportedly charging him twice for same offense

Neymar will receive a refund of the €12 million fine he was ordered to pay by a Brazilian court, after it emerged that he had been prosecuted twice for the same crime. The Brazilian tax agency had accused Neymar of corruption involving his signing for Barcelona, but all charges were dropped.

However, the agency said it would appeal the decision. Neymar’s lawyers said the player had already paid the fine in full, and that he should not have been prosecuted twice for the same offence. A spokesperson for the Brazilian tax agency said: “We will return the money to Neymar because the prosecution was based on a Spanish court ruling that was later overturned. We will study the ruling and decide whether to appeal.”

This is not the first time Neymar has been embroiled in a tax dispute in Brazil. In 2017, he was ordered to pay €45 million in back taxes and fines, after a court found he had evaded taxes on his image rights. Neymar has always denied any wrongdoing, and his lawyers said the latest decision proved he was innocent. The refund of the €12 million fine is a victory for Neymar, but it is unlikely to be the end of his legal troubles in Brazil.

Neymar’s trial comes to an end after accusations of complicity in irregularities

The defendant in Neymar’s fraud and corruption case reduced the prison term it had requested for the player’s alleged involvement in irregularities surrounding his 2013 move from Santos to Barcelona as the trial came to a close on Monday. Three days after the state prosecutor in Spain withdrew the allegations against Neymar, his father, and the former club officials from both Brazil and Spain, the trial came to a close.

The Brazilian business DIS persisted with their accusations but requested a lower prison term of 2.5 years for Neymar and 4 years for the player’s father, who also serves as the player’s agent. For the 30-year-old Neymar, his father, and former Barcelona officials Sandro Rosell and Josep Bartomeu, DIS initially demanded five-year prison terms.

A 195 million euro punishment and 34 million euro restitution from the guilty to the Spanish government are additional demands made by DIS. After hearing Rosell and Bartomeu’s testimony on Friday, the state’s attorney general made the decision to withdraw the charges. He claimed there was no proof of a crime being committed. On Monday, DIS labeled Neymar and his father as traitors for attempting to conceal the transfer’s value. It stated that it regretted the prosecutor’s decision to dismiss Neymar’s charges. Every defendant has said they did nothing wrong.
