The Cup Series race at Richmond two weeks ago saw one of the most controversial finishes ever in the history of the sport. won Austin Dillon the event wrecking Denny Hamlin and Joey Logano on the final corner. NASCAR didn’t let the blatant incident slide and penalized the No:3 team by stripping his automatic playoff spot.

RCR was disappointed with the decision and appealed against it. But the National Motorsports Appeals Panel sided with NASCAR and upholded the penalty. RCR isn’t ready to give up, as they have already started the process to appeal that decision as well, and according to Hall of Famer Dale Earnhardt Jr. they are not wasting time. He reckons they have good arguments.

I think that Austin and his team will put forth a great argument. I don’t think that they’re wasting their time, I don’t think that what they’re going to bring to the table and show to the board is silly.

He went on to point out that RCR believes they have the right data to get a positive verdict from the appeal. The team might be looking into proving that the Joey Logano incident was a normal thing that happens every other week while right hooking Denny Hamlin was just the product of the circumstances and not intentional.

I honestly feel like that they believe what they’re going to tell them. Austin and his team, they’re not sitting here with these stats going, ‘Yeah look at this man, this is fine.’ They’re not lying, they’re not trying to be nefarious or anything. They truly believe that they didn’t do this and they believe they got the data to show.

Dale Earnhardt is okay with the RCR double appeal

While further talking about the point, Junior admitted that unlike some in the NASCAR community he has no issues with the RCR appeal. He then admitted that he doesn’t think they would get a positive result out of it. This is because of the fact that unlike usual penalties, this is a judgement call from NASCAR.

That’s why I’m okay with them appealing, I just don’t believe that they’ll win it. The one thing about this is it’s such a judgment call whereas in most appeals it’s a technical part, an inspection process, a flaw somewhere that a team has stumbled upon intentionally or unintentionally in the processes of technical inspection pre or post-race.

Junior seems to be confident that nothing would change in the situation and his arguments holds some merit. RCR has every right to appeal again as a huge financial gain is on the line because of the incident. It would be interesting to see if they can convince the final appeal officer that they are not guilty.
