Federal Court Asked to Dismiss Kyle Busch’s $8.5M Lawsuit Against Pacific Life

Kyle Busch was recently involved in a Life Insurance Scam, which set him back an astonishing $8.58 million. Back in October, Busch found out about the scam and filed a legal lawsuit against Pacific Life Insurance Company in Lincoln County, holding them accountable for the financial loss. Now, the company is looking to dismiss the lawsuit in the federal court and put it all behind them.

Reportedly, Kyle Busch paid over $10 million to Pacific Life for an Indexed Universal Life (IUL) policy. The policy was supposed to be a great retirement option following his exit from NASCAR racing. However, Busch later found out that the policy was filled with misleading illustrations and false promises. This set him back millions of dollars as his retirement plan was also ruined following the scam.

Then, Kyle Busch took the company to Federal Court, seeking compensation for all the financial losses. The Insurance company has filed multiple documents that prove that Busch purchased five IULs between 2018 and 2022, amounting to over $90 million in compensation. According to sources, Pacific Life has held the RCR star accountable for the financial losses because of his ignorance.

Pacific Life accused Kyle Busch of failing to fully fund the policies over the year, surrendering some of them, and others went lapsed over the years. The policy was signed by both Busch and Samantha Busch, which clearly mentioned that the couple would pay planned premiums for more than 30 years, but after reaching 70 years of age individually.

The Insurance company believes that Kyle Busch and his wife, Samantha Busch, did not read the terms and conditions properly before paying the amount and signing up for multiple IULs. The company is seeking to dismiss the case entirely, with no compensation to the plaintiffs. For now, no other news has come in the matter, but many people are certainly rooting for the NASCAR star to win the battle and get back the money he lost.

Insurance companies often resort to grey tactics to gain an advantage during the signing of insurance for any individual. Since Kyle Busch is a massive figure in the NASCAR industry, the entire case became much more valuable than other such Insurance scam cases. Though one can argue about who is correct in the legal battle, the loss incurred by Busch is certainly not a small amount.

Pacific Life accused Kyle Busch of failing to pay timely premiums and failing to monitor allocation of policy values over the years. The company further claimed that the RCR star was declining responsibility for his own actions and was blaming the defendants for using fishy tactics to scam him. For now, Busch is garnering all the public support he can, as he will certainly need it in later stages of his legal lawsuit against Pacific Life.

Instead of keeping the policies long enough to capitalize on their growth potential, Plaintiffs failed to timely pay planned premiums, failed to monitor allocation of their policy values between indexed and fixed accounts and surrendered the policies or allowed them to lapse, Rather than accept responsibility for their own decisions, Plaintiffs now attempt to blame their negative outcome on the IUL product.

Certainly, Kyle Busch has a lot on his plate right now as the 2026 season of NASCAR is right around the corner. The RCR star is suffering from a massive winless streak in his racing career and must find performance improvements as soon as possible. For now, Busch has yet to provide updates on the lawsuit, but his side of lawyers will definitely not sit quietly following Pacific Life’s latest filing in the matter.
