Cain Velasquez in court

In connection with a shooting that occurred Monday night in San Jose, California, heavyweight champion Cain Velasquez was formally charged with attempted premeditated murder and multiple weapons assault offences. During a “11-mile, high-speed chase” through San Jose, Velasquez pursued Goularte’s truck in his own automobile, slammed it, and then repeatedly fired a 40-caliber revolver into the vehicle, which was hauling Goularte and two elderly relatives. Paul Bender, Goularte’s 63-year-old stepfather, was wounded once in the arm and chest but is expected to make a full recovery, according to court records.

A traffic stop led to the discovery and subsequent arrest of Velasquez, according to court records. He faces charges for three counts of armed assault with a firearm, three counts of attempted murder, and firing at an occupied motor vehicle or aircraft. Goularte, who was unharmed by the incident, is accused of engaging in sexual or lewd behaviour with Cain Velasquez’s daughter, a child under the age of 14.

Velasquez appeared in the Santa Clara County Hall of Justice in San Jose, California, for a hearing where Judge Shelyna Brown once more rejected a motion for release.

The defence was required to present Judge Brown with a change of circumstances in order to contest the court’s decision and maybe reverse the earlier bail denials. Geragos contended that the decision not to testify in a civil complaint by Harry Goularte, Patricia Goularte, and Paul Bender should be viewed as a change in the facts in the criminal case against Velasquez, who is up for a 20-to-life sentence for attempted murder.

A motion hearing for Velasquez is scheduled for August 5 in addition to a plea hearing for him scheduled for August 19. Goularte has, in the meantime, entered a not-guilty plea to the felony accusation of indecent actions with a kid. The preliminary trial hearing for him is scheduled for September 20. On September 6, the summons for the civil case against the Goulartes and Bender will be served.

According to the penal code of California, Velasquez risks a minimum sentence of 20 years and a maximum sentence of life in prison if convicted of attempted murder. If found guilty of more crimes, he could serve more imprisonment.
